Another Bad Business Story

Hello again my friends. As it turns out bad business is very common so I must return to my crusader ways. This story is stranger than fiction as it turns out.

My mom went to visit a cemetery in the capital and on her way into the entrance had to stop to wait on someone to drive away from blocking the entrance. Unfortunately the other person instead of driving away started to reverse.

Sensing a collision, since the other person didn't seem to be aware of her she pressed on her horn to alert them. It didn't work and the other driver scratched their car alongside my mom's

After the collision the occupants of the other car came out and checked their car and said that's they would return from an errand in a bit. My mom waited and on their return approached them about the accident. They were none too pleased and my mother was unable to get anything from them other than a name and the license number of the car.

My mom went to the police station and reported the incident and then went to make a claim at her insurance where it was found the other driver had a policy. The insurance company processed her claim and pending approval from the other driver they were ready to pay my mother for the damage. This was when things started getting troublesome.

The other driver baulked and said they weren't responsible. The insurance company hired an investigator and waited for his assesment. We were sure he'd find for my mother and all would be well... Ah!!

Well life isn't like that the insurance company several days ago decided that my mother was at fault

  1. Apparently no one could find my mother's report at the police station
  2. The other driver said my mother hit them and they were at a standstill.
  3. The fact that the other car had more damage seemed to "prove" it was my mother's fault
  4. The "burden of proof" fell on my mother because she had to cross from one side of the road to the other whereas the other driver was in their lane.

After many days of review by myself, I realised a couple things.

  1. The insurance investigator had asked for the wrong officer when they went to the station making it seem as though my mother had lied.
  2. The real officer rode around all day with the wrecker so he was never in the office when I called or came.
  3. He never made an entry in the log book again making it seem as if my mother lied.
  4. The police department have no effective means of passing on messages. There is no book. There is nothing except hoping that the officer you talk to remembers to pass on the message to the officer before he forgets.
  5. The other driver's entry three weeks after the accident was in the log book of the police station I went to.
  6. Their account at the police station conflicted with the statement they gave to the insurance.
  7. The accident took place completely off the road so all the "burden of proof" and crossing of path junk was pointless
  8. Noone at the insurance wanted to look at the pictures I took because they all "knew" the area. I lived in the area for years myself and I myself thought the accident was on the road and it wasn't at all.

So just so you know guys sometimes you can be completely right and still get completely messed up. When last I went to the insurance agency I :

  1. Dropped off pictures that I took of the accident scene showing everything was off the road.
  2. Dropped off a copy of a page from my mother's diary saying that the lady reversed and hit her amongst other things that happened that day. If my mom lied to herself as well without knowing that someone would see her diary she must be really evil huh? I should watch out :P
  3. I mentioned the discrepancy between the police report and the driver's statement since civilians need a court order or something to be allowed to view the book. A fantastic policeman read the satement to me. In the log the lady said she was "proceeding west" and in her statement she said she was at a standstill.

So guys hopefully the truth will come out. I still have to track down the policeman who took the report. The only thing his compatriots could suggest was that I call no later than 8:20 am to try to get him before he goes out with the wrecker.
